When a company is alleged to have made omissions or misrepresentations regarding certain aspects of the services it provides there exists the distinct possibility of some sort of legal action. When the allegations effect a customer base as large the one Uber lays claim to, its no surprise to see the resulting legal action take the form of a MASSIVE class action lawsuit. The lawsuit called McKnight et al. v. Uber Technologies, Inc. et al has recently come to an agreed upon settlement for a jaw-dropping $32.5 MILLION in hopes of resolving allegations that the Defendants made misrepresentations or omissions regarding the Safe Rides Fee, safety measures, as well as the background check process for potential drivers. It is extremely important to point out that the Defendants vigorously deny (and continue to dispute) all claims and contentions alleged in the lawsuit. However, it appears that at this point the court will not be deciding on who’s right and who’s wrong due to the previously mentioned pending settlement. Wow. What else do I need to know about the Ride Share Settlement?
- Class Members who do nothing will receive an automatic credit off their next Uber ride as payment
- Payment Election Forms must be filed by January 8th, 2017 (if requesting check or PayPal payment)
- January 8th, 2017 is also the date by which exclusion requests and objections must be post-marked
- A hearing regarding the fairness of the settlement is currently set to be held on February 8th, 2018
Class Members who plan on filing a Payment Election Form online can do so directly from the Ride Share Settlement page. Those who would rather file via email or regular mail will need to send the form directly to the Settlement Administrator. Correspondence must also be sent directly to the Settlement Administrator by those who plan on filing a request for exclusion. Class Members with the desire to make their objections known by bellowing them out in court will need to be present at the Fairness Hearing on February 8th, 2017 at 2 PM Pacific Standard Time.
