When consumers begin to suspect a product isn’t living up to its marketing claims it’s usually not good news for the company that manufacturers it as such events have the ability to not only effect sales, but also become the basis for a lawsuit. With that being said, it appears the recently settled case Koller v. Deoleo USA, Inc. is a fairly decent example of the latter. The case was filed over allegations that the Defendant sold its Bertolli olive oil products with claims to be “Imported from Italy” even though most of the oil was extracted from olives grown in countries other than Italy. In addition, the suit goes on to allege that the procurement, bottling, and distribution practices used on the Defendant’s “Extra Virgin” olive oil did not adequately ensure that the products would still meet the standards of “Extra Virgin” by the time they were purchased or by the “best by” date on the packaging. However, it needs to be made clear that the Defendants deny any liability for the previous mention allegations. Further, no ruling has been made by the court on the merits of either sides’ arguments as the Plaintiffs have agreed to settle the case after taking into consideration the risks and expenses of proceeding into further litigation.

Anything else I need to know about this Olive Oil Settlement?

  • The “Extra Virgin” purchases must have been between 05/23/2010 and 04/16/2018
  • The “Classico” and “Extra Light” purchase dates are 05/23/2010 and 12/30/2015
  • The Fairness Hearing is scheduled to be held on 08/09/2018 at 1:30 PM Pacific Time
  • The deadline by which exclusion requests and objections must be filed is 07/12/2018
  • Those who take no action will receive nothing and lose the rights to their own suit

It is very important to note that the deadline by which claim forms must be filed is 30 days after the final approval of the settlement. Those who prefer to file online can get started by going to the Olive Oil Settlement page and clicking the Submit a Claim Form tab. Alternatively, claim forms can also be printed out and sent via U.S. mail directly to the Claim Administrator (must be received by the previously mentioned deadline). Class Members with questions about the settlement can try taking a look at the Frequently Asked Questions section of the class notice or settlement page.
